1. Agreement to Terms

By accessing or using GardenPal at gardenpal.co.uk, you agree to be bound by these Terms of Service. If you do not agree, please do not use the service.

2. Description of Service

GardenPal is a gardening companion web application that helps you track your garden, manage planting tasks, log harvests, and earn achievements. The service is available in a free tier and a premium subscription tier.

3. User Accounts

• You must provide accurate information when creating an account.
• You are responsible for maintaining the security of your account credentials.
• You must not share your account or allow others to access it.
• You must be at least 13 years old to use GardenPal.

4. Free & Premium Tiers

GardenPal offers a free tier with core features and a premium subscription with additional capabilities. Premium features include increased storage, advanced analytics, and calendar integrations.

• Premium subscriptions are billed monthly or annually.
• Payment is processed securely by Stripe. You can manage or cancel your subscription at any time from the Settings page.
• Refunds are handled on a case-by-case basis. Contact us if you believe you are entitled to a refund.

5. Acceptable Use

You agree not to:

• Use the service for any unlawful purpose or in violation of these terms.
• Upload content that is offensive, harmful, or infringes on others' rights.
• Attempt to gain unauthorised access to the service or its systems.
• Use automated tools to scrape or collect data from the service.
• Interfere with or disrupt the service or its infrastructure.

6. User Content

You retain ownership of any content you upload to GardenPal (photos, garden data, notes). By uploading content, you grant us a limited licence to store and display it as part of the service. We will not share your content with third parties without your consent.

7. Data & Privacy

Your use of GardenPal is also governed by our Privacy Policy. You can export or delete your data at any time from the Settings page.

8. Service Availability

We aim to provide a reliable service but do not guarantee 100% uptime. We may perform maintenance or updates that temporarily affect availability. We will endeavour to provide advance notice of planned downtime.

9. Limitation of Liability

GardenPal is provided "as is" without warranties of any kind. Gardening advice and task suggestions are for guidance only and should not be relied upon as professional horticultural advice. We are not liable for any losses arising from your use of the service, including crop loss or damage.

10. Account Termination

We reserve the right to suspend or terminate accounts that violate these terms. You may delete your account at any time from the Settings page, which will permanently remove all your data.

11. Changes to Terms

We may update these terms from time to time. Continued use of the service after changes constitutes acceptance of the updated terms. We will notify you of significant changes via the app or email.

12. Governing Law

These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
